Resolution of DOT Class-Action Grievance

Dear DOT GGU member,

As you may be aware the Governor in his FY 2018 Budget had proposed the outsourcing of DOT Design positions in FY 2018 and FY 2019. His budget language stated that the design function would be entirely outsourced by the end of FY 2019. That would have affected more than 300 of our members.

On submission of his budget I immediately directed that a grievance be filed against the Governor and his Administration for violating the provisions of Article 13 of our CBA. Article 13 requires a feasibility study on any outsourcing be conducted prior to a decision to outsource is made.

The requirements in the LGR go well beyond the language in our CBA. The LGR allows us to have a greater opportunity for input and to affect the study method and results than the language in our CBA provides. 

Even though I have reached the settlement we will continue to be active with the Alaska Legislature urging them to provide in the FY 2018 Budget that no outsourcing of DOT Design positions should occur.
